that anyone would be in a mental hospital mandatorily for life if found criminally insane, isnt the point to get better? Also seems kinda dumb that they would go to jail once better, if they werent responsible for their actions and all

How is that "retarded"?

If they are found to be guilty of a very serious crime, but are found to be insane, they spend life in a mental facility instead of life in prison.

If a doctor deems the person is no longer insane, then they serve the rest of their sentence in prison instead of the hospital.

I dont see the incosistency

Also, just because one is mentally insane does not mean they are not responsible for their actions, where did you get that idea?

why? Because you're supposed to go to a facility to get BETTER, not to be there for life.

And if you've gotten better, why would you go to prison if you were not responsible for their actions.

Legally, if you're insane, you can't be said to be responsible for your actions. Not that I totally agree with that or anything

i mean seriously, if theyre just going to go to prison later, why not throw them in prison now

it voids the whole point of 'treatment' if youre just going to throw them in prison later, and hypothetically if this treatment 'worked' then itd be barbaric to throw a 'cured' person back in prison

Well the thing is you are still responsible for your crime. I dont think theres a law that says you aren't. If you are insane then you are unfit to go to prison and must be treated first in a mental facility, and then serve out the rest of your sentence. It depends on the crime though

so once they get "better" in the mental facility they should be allowed to go free? Mental illness should automatically absolve you of any crime you commit?

and a question for you prisoner of hss, say that woman who was found to be insane for drowning her 4 kids in the bath tub, if after a couple of years she is cured of her mental illness should she not suffer any consequences and be allowed to walk free? is that the kind of justice system you are wanting?

What this boils down to is really the purpose of jail.  Is it meant for correction of the offender's habits, punishment for their crimes, or protection for the public?

thats the whole idea, being sent to a institution isnt supposed to really be a 'punishment'...of course reality is different because the insanity system is a bit bullshit, but ideally, yeah, if someone is 'cured' enough to walk out, they should be allowed free
